A pool permit is required before installing or placing a pool, hot tub, spa, or other structure that meets the definition of a pool on your property. Obtaining a permit helps ensure your proposed pool and enclosure comply with the Town’s Pool By-law, Zoning By-law, and other applicable requirements.
For the purposes of the "Pools By-law", a “pool” is any artificial body of water that can be used for bathing or swimming and is capable of holding 18 inches (460 mm) or more of water. This includes in-ground, above-ground, portable, inflatable and hydro-massage pools, hot tubs and spas, as well as decorative ponds.

What are the requirements for a pool?
All pools must have an approved enclosure that complies with Pool By-law 2011-75. General requirements include:
- Pool enclosures must be a minimum of 1.2 m (4 ft.) in height.
- Where the walls of the pool are at least 1.2 m (4 ft.) above grade, the pool walls may act as the enclosure; however, a compliant enclosure is still required around the pool access.
- All enclosure gates must be equipped with a self-closing and self-latching device.
- Gates must be kept locked when a responsible person is not present and supervising the pool.
- Openings through or beneath the enclosure must not allow the passage of an object greater than 100 mm (4 in.) in diameter.
- Pools are generally permitted in rear yards. Pools proposed on corner lots may require approval from the Manager of Planning.
- Hot tubs must have a lockable lid that is closed and locked when not in use, unless the hot tub is located within a locked pool enclosure that complies with the by-law.
A permit must be obtained before installation, and the required pool enclosure and gates must be in place before water is added to the pool.

What should I submit with my application?
Your application should be accompanied by:
- A detailed plot plan of the property showing the proposed location of the pool and enclosure
- Construction drawings/details, including pool dimensions, pool wall heights/elevations, enclosure details and gate/access details
- A completed permit application form, if submitting the application in person
- Any additional information required to demonstrate compliance with Pool By-law 2011-75
How much does a building permit cost?
Pool permit fees are based on the estimated value of your construction project and are due before a review can be completed. Other fees may apply based on the scope of the project. Fees are outlined in Schedule C of the General Rates and Fees Bylaw.
